EB-5 Investment VISA Program
The EB-5 Immigrant Investor Program was created by an Act of Congress in 1990 as a
means to spur economic growth in the United States. The EB-5 visa is an investor visa:
petitioners invest in a new, job creating enterprise in exchange for permanent
residency in the United States. Unlike other permanent residency visas, the EB-5
visa does not require a minimum level of education, an employment offer, or
sponsorship. But, applicants must invest a minimum of $800,000 (New Act) in a
business or project that subsequently creates at least 10 jobs per investor.
As per the New EB-5 Reform & Integrity Act of 2022 signed by President Biden on
March 15 2022, there are a whole new set of rules for all new EB-5 Investments. Chief
amongst the new rules is the change in the minimum investment limit to $800,000
USD for high unemployment areas and rural area projects. Although rural
projects were also accorded TEA status in the past. The new rules have made some
changes to the rural criteria making them more attractive to EB-5 investors compared to
high unemployment areas (previously known as TEA) projects.
